Ticket: Vehicle met accident by non licensed driver

My Heavy vehicle met accident by my driver with two wheeler. That two wheeler person sent to hospital with serious injury and he died in hospital. My driver not have license . my vehicle have insurance in live. now my question is , whether Victim will get the third party insurance claim or owner of vehicle have to pay the claim amount by own?
